When someone is named as an executor in a Will, they normally have to go through the process of completing a PA1 form to prove they have the authority to carry out their duties.
This document is a Grant of Representation application; Wills and probate solicitors in North Wales can help to complete this.
Most of the time, executors must complete this form but there are some instances when it becomes unnecessary. These could include the estate being dealt with under intestacy rules or if all monies are help in a joint account. Only those formally named as an executor in the Will can apply to complete the PA1 form. However, if the executor does not wish to follow this process and revoke their right to deal with the assets, a next of kin may apply instead.
When the Grant of Representation document is completed, there must be some tasks completed beforehand. The estate, for example, should be valued correctly and legally. Inheritance tax also needs to be calculated and if there is a liability, HMRC should be approached to seek permission to continue with the PA1.
Wills solicitors in North Wales will help to complete to submit other paperwork such as a death certificate and tax forms. It is worth noting that any errors in the submission of paperwork could lead to a fine so legal advice is essential.
