A new survey shows that more than 50% of people in the UK want Will writing and storage to be available as a digital service.
This survey was carried out by Will Aid and the findings show clear public support for modernising the process. A total of 54% said they favoured having the option of electronic Will writing, witnessing and storage. During the Covid-19 pandemic, remote Will witnessing by video was temporarily introduced. Now, 46% of the survey respondents said it should be brought back permanently.
When this video witnessing service was available, the other rules remained the same. It was still necessary for a minimum of two people to witness the signing, and it would be vital that any restoration of the service retains this safeguard.
Having the process witnessed by a professional from Wills and Probate solicitors in North Wales – alongside another independent adult – is crucial to protect people from coercion and fraud. The Ministry of Justice would have to bear this in mind if it decided to change the laws.
Speaking to Today’s Wills and Probate, Lauren Smith from Taylor Bracewell said:
“Whilst so much of everyday life is now dealt with online, it is important to realise that Wills must still meet certain criteria which was set out nearly 200 years ago.”
Not all respondents supported electronic modernisation, as 16% said they were against digital Will signing. Meanwhile, another 23% stated that they disagreed with virtual witnessing.
