The year of 2025 has seen lots of new developments and initiatives in family law already, but solicitors in Llandudno are advising their clients that it is expected that more changes are to come in 2026.
Many of these updates and amendments are due to changes in family life and new advances in technology. The rise in technology including deep fakes have proved problematic in the past for the courts trying to establish facts in family law and domestic abuse cases but the increase in the use of digital forensic experts has tried to address this and it is likely that the use of these will increase as well as other tools to combat fake evidence.
Recent cases such as Standish V Standish have also been used to challenge the beliefs and laws around non-matrimonial property and the importance of clarifying the purpose of assets when transferred between spouses. Some of the other changes that are anticipated by family law barristers in North Wales include acknowledgements of the increase in families created as a result of a surrogacy pregnancy and how this may impact how parental rights are established and how surrogacy agreements are managed.
Other changes will encompass issues like cohabiting couples, the increase in the use of non-court dispute resolutions and schemes to deal with cases involving lower value disputes.
