A Private Client Industry Report commissioned this year has suggested that making a Will, and estate planning in general, is becoming more complicated in the UK.

Currently in the UK, there is an ageing population whilst simultaneously there is an increase in life expectancy. The report points out that this combination can often result in a wider increase in long-term and life-changing illnesses, making paperwork like Wills and lasting power of attorneys in place more essential at a younger age. Over 36% of Wills in 2025 included some sort of arrangement for the management of assets in the case of the testator being incapacitated.
Other issues identified in the report for the ever-increasing complexities of Wills are the anticipated legal updates to Will making expected in 2026, as well as the increase in blended and more elaborate family set-ups. Recent amendments to the Agricultural Property Relief and Business Property Relief have emphasised the importance of careful estate planning using expert legal advice. There also seems to be a growing trend to exclude particular family members from inheriting assets, and many Wills have been very particular about this.
