Many Will writing solicitors are seeing more Wills created or changed at very short notice, such as very shortly before they are needed.
As people live longer, they are more likely to develop life changing conditions such as dementia and terminal illnesses. Although updating a Will is common practice, when someone is doing it because they are close to death, many issues have been known to arise.
It has been shown recently that when Wills are updated last minute, just before someone dies, they are more likely to be contested. There are many reasons why families tend to challenge a Will in these circumstances but some of the most common have been because of alleged undue influence or that the Will has not been properly and legally completed by a solicitor.
There have been several recent examples in court of families and friends legally contesting a last-minute Will. One case involved the children of the testator being disinherited by a change to their father’s Will. The new Will was deemed to be not legal because of undue influence, and the children did inherit the estate. Another instance was a change to a Will when it was proven that the testator was under the influence of strong medication when the amendments were made.
