When family court orders are broken, there can be serious consequences – as demonstrated by a recent case.
This particular example involved a father who persistently ignored orders by a judge to return his daughter to the United Kingdom from Iran. These cases are becoming increasingly common, as family law barristers in North Wales are reporting seeing a rise in similar occurrences.
The details of this particular case are clear, though names of those involved have not been released. The mother of the child took her for a family holiday in Iran, where the youngster was kidnapped by her uncle on behalf of her father. After several pleas for her daughter to be returned, which were ignored, the mother applied to the court for her child to be returned to the UK.
The father of the child did not comply with the orders to return his child to her mother. Although the first appeals were made in late 2024, these continued into this year, with each order being ignored. As a last resort, the judge felt she had no other choice but to sentence the father to six months in prison – though the child has still not been returned.
Family law solicitors in North Wales urge those involved in family law disputes to seek appropriate legal advice to ensure that emotive issues involving children do not escalate into custodial sentences or other serious outcomes.
