Changes expected in UK family law

Many pending changes to family law have already or will be coming into effect in the near future in the UK.

This means that various issues will be dealt with in a slightly different way, and many processes will be streamlined and simplified. Family law barristers in North Wales may continue to keep an eye on other upcoming amendments and will advise their clients appropriately.

One of the most anticipated pieces of legislative updates relates to child custody arrangements. Although no changes have been finalised, it is expected that matters relating to the presumption of parental engagement will be examined further to remove the automatic rights of parents to have access to their children. In cases where parents could potentially be abusive or a danger to their offspring, their contact could be reduced or stopped altogether.

Another matter which has warranted a lot of time and attention is domestic violence. The courts have now been instructed to make the safety of any children involved and those who are victims of abuse, a priority. Although trauma informed has been a term used by many professionals for several years, this approach will also now be applied to any dealings within the legal system.

Later this year, pre-nuptial agreements will be next in line for reform and it is anticipated that issues such as financial transparency and the legalities of the final document will be examined.
