A recent report called Modernising Wills Law has been published that contains many recommendations for changing age-old regulations relating to Will making.
One of the most significant is the introduction of electronic Wills, which will allow Will writing solicitors in North Wales to support people to make this document much more modern and accessible.
Electronic Wills are a new technological development of recent years. Previously, Will writing laws were laid out in the Wills Act 1837 that did not take into account more modern developments in technology. Although there are still concerns about these sorts of Wills such as security and validity, the Law Commission that made the recommendations feel confident that this new form of Wills is needed and long overdue.
At this stage, there is no definitive definition of what digital Wills will look like in practice, but solicitors in North Wales could suggest that there is a probability that strong encryption will be needed to protect the document from unauthorised changes. Another consideration would be electronic signatures. Although these are now becoming more commonplace, in the case of Wills, a foolproof way to authenticate them would need to be written into any programmes.
The issue of witnessing a Will is another matter to consider. One suggestion has been the use of video links, but this has its detractors who claim that the authentication of a witness would be difficult using this process.
