At the end of 2024, a new report was published that proposed to modernise divorce and its financial implications.
The Law Commission Financial Remedies Scoping Report was of particular interest to divorce solicitors in North Wales, as it laid out plans for several areas of legal reform.
One key proposition in the report was the need for a fairer system for dividing assets when couples divorce, as the Matrimonial Causes Act 1973 was no longer fit for purpose in governing these decisions. Current legislation has been deemed confusing and inconsistent, and there is increasing pressure to update these laws.
Although many legal practitioners like family law barristers in North Wales generally welcome updates, there are still those who are concerned that any new changes may not address all current issues. However, the update of this law could include provisions for the courts to make more judgements in the outcome of financial disputes during a divorce.
New ways of calculating spousal maintenance could also be introduced, which may prompt fairer levels of financial support. Regardless of the anticipated updates though, it is not expected that any will come into force until well into 2026.
