Family laws, especially those relating to parenting, need a much overdue overhaul according to many legal experts.
Many solicitors dealing with family law in North Wales have been advising that due to a number of changes in technology and society as a whole, a review of how these laws impact people is needed.
One of the changes that is already underway is the allowing of those who report on legal issues to have access to courts during the hearing of cases. Although there are still strict restrictions on mentioning the names of the children involved, the intention is to introduce greater transparency. This, in turn, is designed to increase the confidence of the public that their cases will be dealt with appropriately.
Another update that solicitors are anticipating is the change designed to give children a greater role in voicing their opinions on family living arrangements; for example, in cases of divorce or separation. Similarly, due to general societal changes in recent years, there is work being done to increase the rights of non-biological and same sex parents.
Other legal matters being examined this year include the increase in use of remote or video-linked hearings, especially in family courts. So far, these have proved invaluable for those who may, for instance, have limited mobility or have vulnerabilities, so an extended roll-out of these are anticipated.
