During 2025, the Terminally Ill Adults (End of Life) Bill was passed in the House of Commons.
Though the bill has not yet been through the House of Lords, it is anticipated that any new legislation will have an impact on Will making and estate planning. If assisted dying becomes legal in the United Kingdom, those considering this option will be urged to review their Wills in detail. However, it is anticipated that any individual looking at assisted dying will have to undergo mental capacity tests and they will also have to demonstrate that they are not being coerced into their decision by others.
There have been some concerns raised, however, that currently, those who may be found to assist someone to die, may be doing so unlawfully and will therefore be subject to the forfeiture rule. This means that they might not be able to benefit from the deceased persons Will. New legislation though, if approved, could absolve those helping someone die, from any guilt if it is shown they acted legally and with consent from the testator meaning they could inherit if named in the Will.
