In January 2023, a pilot governing the reporting of court cases pertaining to family law was introduced. This meant that reporters and other approved personnel were allowed to attend court and report on the dealings that they witnessed – including the role of family law barristers in North Wales.
It is worth noting, however, that there are still restrictions on what can be published – especially in cases where vulnerable people are involved.
The scheme was deemed such a success that it has recently been signed off under a statutory instrument, making these arrangements permanent in family law cases where a transparency order has been granted. Some cases may still be determined as unsuitable for public consumption, however, such as in instances of safeguarding, or where those involved in the court case could be at risk if specific information is published.
At this stage, solicitors specialising in family law in North Wales are not aware of any breaches in requests for confidentiality, so the scheme overall has been seen as a success, opening up new channels of transparency in legal cases involving families.
It is anticipated that the new arrangements will allow members of the public to become more aware of the legalities of family law, as well as promoting accountability in the justice system. It is also anticipated that more consistent decision making will be achieved.
