The growing use of AI in everyday life has recently started to impact on court cases, especially ones relating to family law.
A recent case has highlighted the concerns about the use of technology and how matters of privacy amongst others can be negatively affected. Legal experts have raised concerns that already tense situations can become inflamed with the use of AI.
One example of how the use of technology has impacted a particular case was when a father accessed his partners chat history on ChatGPT during a family law case. The judge, when looking at this evidence, found that this access had inflamed the father further and caused a barrage of verbal abuse directed at the mother.
Solicitors have seen that this unauthorised access to private search histories can ultimately complicate cases, since additional accusations of harassment and coercive control were added to proceedings. Overall, it was judged that these actions added to the issues such as domestic abuse and child welfare. When the father undertook a deep dive into chat histories, he discovered that the mother had been researching matters like partners having affairs.
It is worth noting that the judge concluded that search histories do not always tell the full story, but it is vital to safeguard these and to not assume they are private.
