Study shows majority of cohabiting couples have not made a Will

The latest research shows that the majority of adults who cohabit with their partners have not made a Will.

This research was produced by Will Aid and it makes for alarming reading. A total of 67% of the cohabiting adults that took part in it have never written a Will – which adds up to over three-quarters. Another 9% of those who took part in the research said they have a Will, but that it is out of date.

It is easy to see why so many cohabiting couples are relaxed about Will writing though. 35% of them told the research they assumed their partners would inherit their estates, whether they have one or not. This is 10% higher than in 2025.

This belief does not reflect the law though, which makes it vital that they speak to unmarried cohabitation solicitors in North Wales or England. Professionals of this kind will make it clear that a Will is needed to ensure their partners inherit.

Data issued by the Office for National Statistics shows that the UK has around 3.5 million cohabiting couples. Therefore, this widespread ignorance about their inheritance status under the law is a problem.

The Will Aid campaign director is Peter de Vena Franks. Talking to Today’s Wills and Probate, he said:

“So many people are sharing their lives, homes and finances with a partner, yet three-quarters have no up-to-date Will in place to make sure their wishes are respected.”
