A ruling in favour of a husband has been handed down in a case that saw a wife destroy evidence of a prenuptial agreement.
The Central Family Court hearing in this case lasted for five days. The divorcing couple at the centre of it had been married since 2012 and have two children. The husband is employed by an investment equity firm and has an annual income in the region of £1.5 million. His spouse stayed at home during the marriage, but is now retraining and can expect to earn up to £27,000 per year once qualified.
At the root of this unusual case was a signed prenuptial agreement determining how assets should be split. Under its terms, the wife was entitled to just under £3 million, plus the right to live in the family home until both children have been educated.
However, this signed agreement was destroyed by the wife, and she then claimed that it never existed. The husband was able to find proof of it through email investigation, but the case demonstrates the value of having solicitors in North Wales hold a prenuptial agreement on your behalf.
Judge Edward Hess handed down the ruling, which was broadly in line with the terms of the agreement. He criticised the drafting for a lack of clarity and professionalism, but felt that the wife had accepted it at the time and had not been honest in court about its existence.
