In August 2025, a court case became a vehicle for a judge to throw out previous recommendations in relation to a domestic abuse situation, which were now deemed to be outdated and dangerous.
The judge, Mr Justice Garrido KC, examined a series of allegations made by a mother against the father of her children and decided that the original judgement was wrong. Domestic abuse solicitors in North Wales may see this ruling as a much-needed updating of domestic abuse decision-making.
In this particular case, both the mother and father of the children made claim and counter claims against each other, stating that a range of domestic abuse and violence incidents occurred. These allegations started in 2009 and continued until the present date, with one of the most serious being an attempted murder charge being potentially brought against the father. The judge initially involved in the case had claimed that all of the abuses did not impact the children in the family, and contact arrangements for the father should not be diluted.
However, experts now believe that the overturning of the original ruling means that fact finding hearings should be used more often to ascertain the facts of a case, and that the voices and opinions of the children impacted should be taken into account when decisions about their futures are being made.
